लोकतन्त्रमा टुहुरो जलस्रोत


रामसार सीमसार महासन्धिमा दरएिको कोसी टप्पु वन्यजन्तु आरक्षको सिमाना खुम्च्याउने काम मुग्लानी इच्छाको भरमा हाम्रा सरोकारवाला वन, जलस्रोत र रक्षा मन्त्रलायलाई थाहै नदिईकन 'विदेशी प्रभुको सामु नझुक्ने' प्रचण्ड-वामदेव सरकारले ठाडो क्याबिनेट प्रस्तावद्वारा सुटुक्क गरेको यसै साप्ताहिकमार्फत गत साता खुलासा भयो । गत साता नै नेपाल र भारतका मन्त्रीहरूले तल्लो कोसीमा यस सन्धिले निम्त्याएको विपत्ति अवलोकन गरी सन्तुष्टि व्यक्त गरे ।
तर, यस विषयमा सिमाना मिचियो भनेर कालापानीमा खुकुरी नचाउने, सुस्तामा झन्डा फहराउने र टनकपुरमा आधा किलोमिटर नेपाली भूभाग मिचिएकामा बबन्डर मच्चाउनेदेखि लिएर विपक्षको ओहदा ओगटेकासम्म कसैले बोलेको सुन्नमा आएको छैन । जबकि, यसले अन्तरमि संविधानको धारा १५६ -२०४७ सालको धारा १२६) आकर्षण गर्छ । के त्यो धारा सँगसँगै नेपालको राष्ट्रिय स्वाभिमान लोकतान्त्रिक बाढीले बगाएर लगेको हो त ?
विसं ०४६ को जनआन्दोलन र त्यसद्वारा ०४७ को संविधानको धारा १२६ नेपाली जलस्रोतलाई उपनिवेशीकरणबाट जोगाई स्वावलम्बी बाटोतर्फ डोर्‍याउने सशक्त संस्थागत औजार थियो । जलस्रोत विकासका योजनाहरू संसद्मा पेस हुनुपर्ने र व्यापक गम्भीर र दीर्घकालीन खालका भए राष्ट्रिय सहमति आवश्यक हुनुपर्ने अत्यन्तै प्रजातान्त्रिक व्यवस्था यस प्रावधानले गरेको थियो । नेपालमा कमजोर शासन भएका बेला आफू अनुकूलका योजनाहरू थोपर्न सफल मुग्लानी साहूलाई यो प्रावधान मन नपर्ने त थिँदै थियो, पारकिो साहूलाई खुसी पारी सत्तारोहण गर्ने हाम्रै नेता र आर्थिक वृद्धिदरले उतै लगानी गरे बढी फाइदा देख्ने अन्तर्राष्ट्रिय वित्तीय संस्थानहरू र तीसँग हिमचिममा रहेका विकासे व्यापारीले पनि यसलाई रुचाएनन् । फलस्वरूप धारा १२६ तुहाउने खेल महाकाली सन्धि हुनुअगावै प्रारम्भ भइसकेको थियो ।
महाकाली सन्धि जबरजस्ती दुईतिहाइ बहुमतले पारति त गरयिो तर गलत ढंगले गरेको हुनाले त्यो अचेत अवस्थामै रही दसवर्षे आयु काट्यो । सीमा नदीको हैसियत, नेपालको पानी अधिकार जम्मा चार प्रतिशतसम्ममा सीमित हुनसक्ने खतराजस्ता सन्धिका अन्योल र विसंगतिहरूलाई नसच्याई एकतर्फी ढंगले संकल्प प्रस्तावमार्फत त्यसको पुनःव्याख्या गरयिो । अध्ययनपछि सन्धि गर्नुको सट्टा सन्धिपछि अध्ययन गर्ने भनियो । त्यो पनि विवादास्पद व्याख्याभित्र रही, जसले गर्दा सन्धिमै तोकिएको अध्ययन पनि हुन सकेको छैन । अब त सन्धिले तोकेको दसवर्षे आयु पनि सकिएकाले तीन वर्षदेखि यो सन्धि मृतप्रायः छ । र, त्यसलाई पुनःजीवित गर्न जसरी अनुमोदन गरयिो, त्यसैगरी संसद्को दुईतिहाइ बहुमत चाहिन्छ । तर, त्यसका लागि आवश्यक चिन्तन, ढंग र इच्छाशक्तिको राजनीतिक खडेरी खासगरी ठूला पार्टीहरूमा रहेकाले क्यान्सर स्वरूपको यो दीर्घरोग नेपालमा रहिरहने छ ।
पारपिट्ट िभने 'हाइड्रोपोलिटिक्स्'को खेल जारी छ र हाम्रा कुर्सीको राजनीतिमा मात्र सीमित रहेका नेताहरू त्यसमा फस्दै गएका छन् । अरूको त कुरा छोडौँ, 'असमान महाकाली सन्धि खारेज गर' भनेर जनयुद्ध सुरु गर्ने माओवादीको भाषामा सत्तारोहणपछि 'पञ्चेश्वर अगाडि बढाउने' मधुरध्वनिहरू सुनिए । प्रचण्डको सरकारलाई विस्थापित गरेर आएको वर्तमान गठबन्धन सरकारले बजेटमा पञ्चेश्वर ब्यूँताउने प्रावधान राख्दा प्रतिपक्षी माओवादी बोल्दैन । प्रतिष्ठित पत्रकार र नागरकि अगुवाहरूले पनि महाकाली सन्धि विरोध गर्नेहरूलाई विरोधको सट्टा सहयोग गर्न सिक्ने सल्लाह दिइरहेका छन् । मानौँ, नेपालको गाउँ डुबाएर मुग्लानका फाँट सित्तैँजसोमा सिँचाइ गर्ने योजनाको विरोध गर्दा 'खोक्रा राष्ट्रवादीहरू ! करणी अवश्यंभावी भएकाले मोज गर्न सिक' भनेझैँ लाग्छ ।
यस्तो सोचाइमा परविर्तन कहिले र कसरी आयो भन्ने अनुसन्धान गर्दा बहुमत प्राप्त नेपाली कांगे्रसको सरकार हाँकिरहेका प्रधानमन्त्री कृष्णप्रसाद भट्टराईलाई चैत ०५६ मा जबरजस्ती अपदस्थ गरेको घटनासँग जोडिन पुग्छ । कुनै कसुर नगरेका, बरु जसको नाममा कांग्रेसले चुनाव जित्यो, तिनैलाई प|mान्सको आसन्न औपचारकि भ्रमणसमेत रद्द गर्न लगाई किन हठात् निकाल्नुपर्‍यो ? यसबारेमा आजसम्म नेपाली जनतालाई नेपाली कांग्रेसले प्रस्ट्याउन सकेको छैन । त्यसपछि प्रधानमन्त्री भएका गिरजिाप्रसाद कोइरालाको कार्यकालमा दरबार हत्याकाण्ड भयो र उनी स्वयंले होलेरीमा ४१ प्रहरीलाई माओवादीले बन्दी बनाएको घटनालाई लिएर राजीनामा गरे । गणितीय बहुमतमा रहेको कांग्रेसले त्यसपछि एउटै संसद्मा तेस्रोचोटि प्रधानमन्त्री फेर्‍यो । आफ्नै सन्त सहयोगीको राजनीतिक घाँटी निमोठ्न संकोच नमान्ने र गएको चुनावमा आफ्नो पार्टीले नराम्रोसँग हार खेपेपछि महिनौँ पद नछोड्ने व्यक्तिले ४१ जना प्रहरीका लागि प्रधानमन्त्री पद त्यागे भनेर पत्याउन सकिँदैन ।
कुरा अब खुल्दैछ, जुन पछि गएर जलस्रोतसित जोडिन्छ । केही महिनाअघि सिंगापुरबाट पूर्वयुवराज पारस शाहले दरबार हत्याकाण्डबारे अन्तर्वार्तामा केही खुलाएका थिए । हुन त पारस भन्नेबित्तिकै नाक चेपर्‍याउने र मुन्टो बटार्ने धेरै छन्, सायद त्यही भावनाले गर्दा सो अन्तर्वार्ताको विश्लेषण नगरएिको होला । तर, हत्याकाण्डपछाडिका कारक तत्त्व देवयानी-ऐश्वर्य कटाक्ष, दीपेन्द्रले ०४६ को बहुदल घोषणा आत्मसात् गर्न नमानेको र सेनालाई हतियार खरदिबाट आउने कमिसन रहेको पारसले खुलासा गरेका छन् । पहिला दुई व्यक्तिगत मनोवैज्ञानिक भए पनि तेस्रोचाहिँ सार्वजनिक चासोको विषय हो । भट्टराईको अपदस्थी, कोइरालाको अपत्यारलिो राजीनामा र त्यसपछिका प्रधानमन्त्री शेरबहादुर देउवा दक्षिण अपि|mका प्रस्थान गरेका भए पनि हतियार किनमेललाई लिएर बेल्जियममै हराउनु रहस्यमय घटनाहरू हुन् ।
यी घटनाहरू जनआन्दोलन-२ को प्रारम्भसित जोडिएको थप प्रमाण एक राष्ट्रिय पत्रिकामा उजागर गरएिको छ, जहाँ दाबी गरएिको छ कि ०६१ सालमा गिरजिाप्रसाद कोइराला चीन भ्रमण सकी काठमाडौँ नफर्की सोझैँ दिल्लीतर्फ हानिएका थिए, जहाँ भारतीय संस्थापन पक्षले आफ्नो पहलमा उनलाई पहिलोपटक विद्रोही माओवादी नेताहरूसँग भेटघाट गराएको थियो । स्मरणीय तथ्य केे छ भने त्यसबखत प्रधानमन्त्री -उनीपछिका) देउवा नै थिए, जो संकटकाल लागू गराएर विद्रोहीसँग युद्ध गर्दै थिए र भारतले पनि माओवादीलाई आतंककारी घोषित गरेको थियो । यस हिमचिमले केही समयपछि १२ बुँदे दिल्ली समझदारीको रूप लियो । अन्य भाषामा 'टि्रसन' भनिने यो कार्य पटकपटक प्रधानमन्त्री भइसकेका व्यक्तिले विदेशीको अगुवाइमा किन गरे भन्ने प्रश्न अगाडि आउँछ । र, सबैभन्दा सरल 'हाइपोथेसिस' त्यही हुन्छ, जसले सबैभन्दा धेरै अथ्र्याउँछ, त्यो हो- एक कांग्रेस नेताको भाषामा, जोसित जे सम्झौता गरेर भए पनि सत्तारोहण गरी छाड्ने अठोट ।
यस अठोटसँगै जन्मेको सात पार्टीको एकता र माओवादीसँगको १२ बुँदे समझदारीमार्फतको सहकार्यलाई सहयोग गर्न अघोषित रूपमा मुग्लानी सर्तनामा तीनवटा थिए । पहिलो, ३० लाखलाई नागरकिता दिने । यस मामिलाबारे प्रमाणित तराईका बासिन्दालाई नागरकिता दिन कसैको आपत्ति नभए पनि प्रसस्त भारतीयहरूले नागरकिता लिए, खासगरी पश्चिममा पिलिभितदेखि पूर्वमा सिलिगुडीसम्मका अपराधी तत्त्वहरूले । यसले नेपालको राजनीतिलाई उलटपलट गरेको विगतको चुनावमा देखियो र तराईमा बढेको आपराधिक क्रियाकलापले गर्दा उत्तरी भारतलाई समेत गाँज्ने देखिँदैछ ।
दोस्रो सर्तनामा सुपुर्दगी सन्धि थियो । तर, सन्धिबिना नै र अदालतको आदेश नमागीकनै हाम्रा नेताहरू जोसुकैलाई पनि सुम्पिन तँछाडमछाड गररिहेको स्िथतिमा सन्धि नभईकन पनि स्वतन्त्र नेपालले मुग्लानलाई अपूर्व सेवा पुर्‍याइरहेको स्िथति छ ।
तेस्रो सर्तनामा जलस्रोत रहेको देखिन्छ । यसको पहिलो प्रमाण पुनःस्थापित प्रतिनिधिसभाले दियो । '२ सय ३८ वर्ष'को अस्ितत्व मेट्ने गरी पारति ऐनहरू राजाबाट लालमोहर लगाउन नपर्ने व्यवस्था गर्न संसद् नियमावली फेरयिो । तर, सँगसँगै दफा १३६, २३० र २३२ का प्रावधानहरूले 'सम्पूर्ण सदस्य संख्याको कम्तीमा दुईतिहाइको उपस्िथतिमा उपस्िथत सदस्य संख्याको दुईतिहाइ बहुमतबाट स्वीकृत भएमा विधेयक पारति भएको मानिने छ' भनेको छ । अर्थात्, बहुमतमा चल्ने लोकतान्त्रिक पद्धतिमा जाबो ४४ प्रतिशतले जलस्र्रोत मुग्लानी साहूलाई सुम्पिन सक्ने भयो । यसै व्यवस्थामा माओवादी पनि सम्मिश्रति हुन आयो र सरकारमा गएपछिका क्रियाकलापले जनआन्दोलन-२ को समर्थनका लागि साहूले तेस्र्याएका सर्तनामाहरू शिरोधार्य गरेको प्रमाणित गर्‍यो ।
माओवादी सम्मिलित सरकारले नेपाली विद्युत् प्रणालीलाई अत्यावश्यक अरूण-३, माथिल्लो कणर्ालीजस्ता 'साइट'हरू नेपाल र नेपाली उद्योगधन्दालाई नभई विदेश निर्यात गर्नाका लागि दान गरििदयो । पुनःजीवित प्रतिनिधिसभामा पश्चिम सेती आयोजनाबारे ढिलै भए पनि बहस चल्यो र नेपालले सित्तैँमा पाउनुपर्ने १० प्रतिशत बिजुली नै पाउनुपर्ने भन्ने स्वागतयोग्य निर्णय गर्‍यो । तर, त्यो निर्णय न त्यसबखतको माओवादी सम्मिलित कांग्रेस नेतृत्वको सरकारले कार्यान्वयन गर्‍यो, न त्यसपछिको माओवादी-एमाले सरकारले । उल्टै अस्ट्रेलियाको लाइसेन्सवाला कम्पनीसँग भएको विद्यमान सहमतिबमोजिम नेपालले एक थोपा पानी र बिजुली नपाउने यस योजनामा नेपाल सरकारले चर्को ब्याजदरमा साढे चार करोड अमेरकिी डलर लगानी गर्ने भएको छ । मुलुकले भोगिरहेको चर्को लोडसेडिङ् अन्त्य गर्न भने त्यस्तो कुनै जोहो तीनैवटा लोकतान्त्रिक सरकारले गरेका छैनन् । त्यसैले पारकिो साहू मात्रै नभई समुद्रपारकिा साहूहरू पनि यस्तो राजनीतिक परपिाटीसँग खुसी नै हुनुपर्छ ।
अहिले कणर्ाली आयोजनाबाट उत्पादन हुने १० हजार मेगावाट बिजुली स्याटेलाइटमार्फत चीन पठाउने भन्ने व्यक्ति नेपालको प्रधानमन्त्री पदमा आसन्न छन् । उनी भर्खरै मात्रै इजिप्टमा असंलग्न राष्ट्रहरूको शिखर सम्मेलनमा भाग लिएर स्वदेश फर्केका छन् । त्यस आन्दोलनले प्रतिपादित गरेको स्वावलम्बी अर्थराजनीतिक विकास उनले कति आत्मसात् गरे, आगामी दिनहरूले बताउलान् ।
तर, अहिलेसम्मको लोकतान्त्रिक सरकारहरूको क्रियाकलाप हेर्दा आश गर्ने ठाउँ कमै देखिन्छ । लोडसेडिङ् जारी नै छ र आउने हिउँदमा दिनको छ घन्टा मात्र बिजुली पाइने समस्या टड्कारो अगाडि छ । विद्युत् संकटकाल घोषणा त गरयिो तर त्यस अनुरूप कुनै काम भएन, पुष्पकमल दाहाल टोलीको नर्वे र फिनल्यान्ड भ्रमणबाहेक । भारतबाट बिजुली आयात गर्ने भनिन्छ तर भारतमै १० हजार मेगावाटको कमी छ र चार सय किलो भोल्टको प्रसारण लाइन बनाउनै दुई वर्ष लाग्छ, त्यो पनि भारतले चासो राखेमा । विद्युत् महसुलमा संरचनागत सुधार र समायोजन नभएको नौ वर्ष भयो । विद्युत् व्यवस्थापनमा सुधार ल्याउन नयाँ ऐन आवश्यक छ तर यसअघिको सरकारले पेस गरेको विद्युत् ऐन यति त्रुटिपूर्ण छ कि त्यसको फेहरस्ितमै सात-आठ पृष्ठ खर्च हुन्छ । सबैभन्दा डरलाग्दो कुरो त्यो प्रस्तावित ऐन त्यही रूपमा पारति भए जलविद्युत्मार्फत नेपाल उपनिवेश बन्ने पक्का छ । र, साम्यवादी-समाजवादीहरूले स्वतन्त्र राष्ट्रलाई उपनिवेश बनाएको हेर्दा विश्व नै छक्क पर्नेछ । जलविद्युत्का कतिपय योजनाहरू पानीका मुद्दासँग अभिन्न सरोकार राख्छन् तर जलस्रोत मन्त्रालयलाई ऊर्जा र सिँचाइ भनी दुई भिन्दाभिन्दै मन्त्रालय बनाइएको छ । यो काम कुनै विषयवस्तुको कारण नभई विशुद्ध पार्टी कार्यकर्तालाई मन्त्रीको कुर्सी दिलाउन र पार्टीहरूलाई भागबन्डा मिलाउनका लागि भएको छ । अब पञ्चेश्वर, कोसी, कणर्ालीजस्ता बहुउद्देशीय योजनाबारे कुन मन्त्रालयले मुग्लानी सरकारसँग कुरा गर्ने ?
यस्तो परििस्थतिलाई अनुभूत गरेर मर्माहत हुने यो देशलाई माया गर्ने मात्र हुन्छन्, अरू भने संकटकालमा यस्तै हो भनेर चित्त बुझाउन सक्छन् । जबकि, देश संकट अन्त्य हुनेतर्फ नगई महासंकटतर्फ रफ्तारएिको भान हुँदैछ ।

हामी नेपाली

अन्तिम लडाइँको गन्ध




यो देश धेरैले सोचेभन्दा धेरै बलियो छ तर धेरैले सोचेभन्दा धेरै जर्जर पनि भइसकेको छ । यो देशका अभूतपूर्व राजनीतिक घटनाक्रमहरू तुलनात्मक रूपमा शान्तिपूर्ण ढंगबाट जसरी अघि बढे, ती साँच्चीकै असाधारण उदाहरणहरू हुन् तर हाम्रो भविष्य महाभीरमा उभिएको छ भन्ने तथ्यलाई अस्वीकार नगरौँ ।
अनौपचारकि कुराकानीमा सबै दलका नेताहरू यस्तै चाला हो भने संविधान ढिलो लेखिने मात्र होइन, लेखिँदै नलेखिन सक्छ भन्न थालिसकेका छन् । संविधान निर्माणको पूर्वनिर्धारति कार्यतालिका पाँचपटक संशोधन भइसकेको छ । संविधान लेख्न १० महिना मात्र बाँकी छ । संविधानसभाको सबभन्दा महत्त्वपूर्ण संवैधानिक समिति माधव नेपाल प्रधानमन्त्री बनेपछि सभापतिविहीन भएको छ । संविधानको अवधारणा बनाउने ११ मध्ये सातवटा समितिहरूले आफ्नो मस्यौदा तयार पार्न सकेका छैनन् । ती समितिहरूभित्र महत्त्वपूर्ण विषयहरूमा सहमति हुन सकेको छैन र कतिपय विषयहरू यति जटिल छन् कि तिनमा सहमतिको सम्भावना एकदम कम छ । हुँदा-हुँदा छलफल गर्ने मस्यौदा र अवधारणाको अभावमा संविधानसभा नै कार्यसूचीविहीन भएर अनिश्चितकालका लागि स्थगित भएको छ । विषयको गाम्भीर्यलाई सबैले बुझेका छन् तर सबै 'मै ठीक'मा अडिग छन् । अहिले त चाला यस्तो छ भने जब दुई-तिहाइ बहुमतले संविधानका धाराहरू पारति गर्नुपर्ने हुन्छ, सहजै अनुमान लगाउन सकिन्छ, स्िथति कस्तो होला ।
यहाँ धेरै विश्लेषक र राजनीतिज्ञहरूमा दृढ विश्वास के छ भने स्िथति जति नै जटिल अवस्थामा पुगे पनि अन्ततः सहमति हुन्छ । कुरा साँचो हो किनभने अहिलेसम्म भएको पनि त्यही हो । हरेकचोटि 'लौ अब बर्बाद भयो, अब ठूलै अनिष्ट हुने भयो, देश भीरबाट खस्ने भयो' भन्ने अवस्थामा पुगेपछि, सबै मिलेर या एउटा पक्ष झुकेर, देशलाई पुनः सुरक्षित स्थानमा तानेर लिएर आउने गरएिको छ । तर, त्यस्तो खतरा सधैँ मोलेर, गर्व गर्ने कुरा होइन । खसेपछि त खसिहाल्यो, सक्किहाल्यो । माओवादीहरू 'संक्रमणकालमा यस्तो भइहाल्छ, आत्तिनु हुँदैन' भनेर यो अवस्थाको औचित्य पुष्टि गर्न पनि खोज्छन् । त्यसबाहेक देशमा शान्तिसुरक्षाको स्िथति नाजुक छ भने क्षेत्रीयता, जातीयता, दण्डहीनता, अराजकता, अकासिँदो बजारभाउ आदिबाट सर्वसाधारणले सामना गर्नुपरेको समस्याको त कुरा गरेर साध्य भएन ।
यस्तो अवस्थामा देश बढ्दो रूपमा 'अन्तिम लडाइँ'को चरणमा प्रवेश गर्न लागेको गन्ध आउन थालेको छ । माओवादीहरू अहिले त्यो चाहँदैनन् किनभने, उनीहरूमा त्यस्तो लडाइँबाट आफू हावी हुने विश्वास छैन । हुँदो हो त, उनीहरूले त्यो बाटो निश्चय पनि अवलम्बन गर्ने थिए । अन्य दलहरू पनि त्यस्तो लडाइँको पक्षमा छैनन् । तर, नेपाली सेनाका कतिपय उच्चपदस्थ जनरलहरू र खासगरी सेनापति रुक्मांगद कटवाल बढ्दो रूपमा 'फाइट टू फिनिस'को पक्षमा रहेको देखिन थालेका छन् । उनीहरूको मान्यता के छ भने, 'माओवादीहरूले देशमा लाद्न चाहेको सर्वसत्तावाद नै हो, तिनीहरूका लागि एउटै अड्चन भनेको नेपाली सेना मात्र हो, देशमा लोकतन्त्र जोगाउने हो भने माओवादीहरूलाई सबै लोकतन्त्रवादीहरू मिलेर, सेनाको सहयोगमा पेल्नैपर्छ र त्यसका लागि अहिलेको भन्दा अर्को राम्रो अवसर आउन सक्दैन किनभने माओवादीहरू अहिले जति कमजोर अवस्थामा पहिले कहिल्यै थिएनन् ।'
माओवादीहरू अहिले कमजोर अवस्थामा भएको कुरा साँचो हो । अब अधिकांश माओवादी नेताहरू फर्किएर जंगल या भारत जान सक्दैनन् । ती जंगल र भारतको बसाइँबाट थाकिसकेका छन् । धेरैले त प्राडो र पजेरोको स्वाद पनि चाखिसकेका छन् । भारत जानका लागि त पहिलेजस्तो दिल्लीले आँखा चिम्लिदिने सम्भावना पनि कम छ । सहरी विद्रोहबाट ती सफल हुने सम्भावना झन् कम छ । तिनले सहरी विद्रोहको धृष्टता गरे भने सम्पूर्ण माओवादीइतरका शक्तिहरू एक भएर सबै सुरक्षा निकायहरू परचिालित गर्नेछन्, जसलाई माओवादीहरूले थेग्न सक्ने छैनन् । तिनलाई अन्तर्राष्ट्रिय समुदाय, खासगरी भारतको पनि सहयोग हुने छैन । सोही तथ्यलाई बुझेर माओवादीहरू अहिले हरेक मोर्चाबाट पछि हट्दैछन् । यही मौका छोपेर सेनाचाहिँ बढी आक्रामक हुँदै अघि बढ्न खोजिरहेको छ । सेनापति कटवाल माओवादीहरूले संसद् खोल्न दिएकामा अत्यन्त निराश भएको हुनुपर्छ किनभने संसद् नखुलेको भए राष्ट्रपति र दलहरूसमक्ष आफ्नो चाहनालाई सावित गर्न उनलाई ठूलो मौका मिल्ने थियो । सो मौका गुमेका कारण कटवाल आफूले अवकाश पाउनुअगाडि नै स्िथतिलाई चर्काउने अर्को मौकाको खोजीमा भएको देखिन्छ । यदि सेनाले घातक हातहतियार, नियमित पदपूर्ति र नयाँ दरबन्दीका लागि गरेको प्रस्तावबारे अखबारहरूमा आएका समाचारहरू सत्य हुन् भने त्यो वर्तमान राजनीतिक स्िथतिलाई चर्काउन जानीजानी गरएिको प्रयास हो भन्ने सहजै बुझ्न सकिन्छ ।
कटवालले सैनिक संस्थाका लागि लिएको अडानबाट सेनाभित्र र बाहिर जुन विश्वास जितेका थिए, अहिले त्यो विस्तारै कमजोर हुँदै गएको छ । पछिल्लो समयमा आएर हरेक कुरामा उनी सरकारलाई 'डिक्टेट' गराउन खोजिरहेका छन्, जसले पछिका लागि पनि राम्रो नजिर स्थापना गर्दैन । घटनाक्रमले अनपेक्षित मोड लिएको अवस्थामा बाहेक अबको छोटो पदावधिका कारण कटवाल स्वयंले सेनालाई राजनीतिमा होम्ने सम्भावना अत्यन्त न्यून छ तर पछिल्ला दिनहरूमा उनले सेनाभित्र र बाहिर यस्तो माहोल सिर्जना गर्न खोज्दैछन्, जहाँ उनको सोचाइमा दुई पक्ष मात्र हुन सक्छन्, कि माओवादी भितरको कि इतरको पक्ष । त्यो रेखा नखिच्ने हो भने नेपाल सधैँ घसि्ररहन्छ र नेपालमा शान्ति र लोकतन्त्र स्थापना हुन सक्दैन भन्ने सन्देश उनले सबैतिर प्रवाहित गररिहेका छन् । कटवालले अवकाश पाए पनि त्यो सन्देशसँग सहमत जनरलहरू नेपाली सेनामा धेरै छन् । त्यसैले, राजनीतिक तहमा यस्तै अस्तव्यस्तता रहने र शान्ति प्रक्रिया र संविधान लेखनको कुरा यसैगरी अन्योलमा रहिरहने हो भने आउँदा दिनहरूमा सेना नेपाली राजनीतिमा राम्रैसँग हावी हुने सम्भावनालाई नकार्न सकिँदैन । जर्जर देशमा 'अन्तिम लडाइँ' भयो भने स्िथति के होला, जिम्मेवार पक्षहरूले गम्भीरतापूर्व सोचिदिए सबैको भलो हुने थियो ।

जय सिनेमा

काठमाडौं, कम्युनिस्ट पार्टीमा संगठित भएकाहरू भ्ोटेमा लालसलाम भनी सम्बोधन गर्छन् । त्यस्तै नेपाली कांग्रेसमा मत राख्नेहरू जयनेपाल भन्ने गर्छन् । हरेक राजनीतिक पार्टीको आ-आफ्नै सम्बोधन गर्ने शैली भएजस्तै चलचित्र क्षेत्रलाई नै पेसा बनाएकाहरू सम्बोधनमा के भन्छन् भनेर कसैले सोधे तपाइर्ं अलमलमा पर्न सक्नुहुन्छ ? अब भने अलमल हुन पर्दैन ।
चलचित्रकर्मीको आफ्नै सम्बोधन प्रयोग गर्न सक्नुहुनेछ । त्यो हो 'जय सिनेमा' । अब तपाईको मनमा यो कसरी भयो भनेर खुलदुली लागेको होला । खुल्दुली लाग्नु पनि

स्वाभाविकै छ ।

विगत ७ महिनादेखि जय सिनेमा अभियानलाई अगाडि सारेका छन् एकजना क्यामराम्यानले । उनको नाम हो दीपक बान्तोवा ।

पुरानो चलचित्र 'चिनो' मा छायांकनको भूमिका निर्वाह गरेर चलचित्र क्षेत्रमा पाइला टेकेका दीपक अहिले चलचित्रमा जय सिनेमाको अभियान अगाडि सार्नतर्फ धमर्धुस छन् । अभियानको पहिलो सुरुवात करिब ३ जना कलाकारलाई एसएमएस पठाएर गरे । यतिमात्र कहाँ हो र उनले लगभग ३/४ सय वटा जय सिनेमा लेखेको टोपी चलचित्रकर्मीलाई लगाउन प्रेरित गरे भने आफू पनि स्वयम् लगाएर हिँडे । यस्तैगरी नयाँ वर्षको उपलक्ष्यमा जय सिनेमा लेखेको क्यालेन्डर, क्यामेरा कभरसमेत बाँडे ।

यसो गर्नुको मुख्य उद्देश्य के होला भनेर तपाईको मनमा अर्को खुल्दुली लागेको होला । दीपकका अनुसार नेपाली चलचित्रमा चलचित्रकर्मीको आफ्नो छुट्टै पहिचान देखाउन उनले यस्तो अभियान चालेको बताए । र यो अभियानलाई सबै कलाकारले पनि स्विकारेको उनको विश्वास छ । 'सबै कलाकारले यो अभियान मन पराए,' उनले भने, 'अझ यसलाई सहयोग गर्न पनि तयार छन् ।'

दीपकको यस अभियानलाई नेपाली कलाकारिता क्षेत्रमा स्थापित गराउने धोको छ । नभन्दै अचेल उनको यो धोको साँच्चिकै पूरा होलाजस्तो छ । के आधार जान्न चाहनुहुन्छ ? अचेल दीपकको जय सिनेमा अभियानलाई नेपाली चलचित्रकर्मीदेखि दिएर कार्यक्रम सञ्चालकहरूले समेत मुखमा 'जय सिनेमा' झुन्डाएका छन् । कलिउडकी प्रथम महिला निर्देशक सुचित्रा श्रेष्ठले यस्तो अभियानले चलचित्रकर्मीलाई आफ्नो कामप्रतिको सम्मान हुने विश्वास राख्छिन् । 'कलाकारिता हाम्रो पेसा हो,' सुचित्राले गर्भ गर्दै भनिन्, 'यसको सबैले सम्मान गर्न सिक्नुपर्छ र अरूभन्दा पृथक् हुनुपर्छ ।'

कार्यक्रम सञ्चालक प्रकाश सुवेदीले आफ्नो हरेक कार्यक्रमको सुरुमा र अन्त्यमा जय सिनेमा भन्न छुटाउँदैनन् । प्रकाशको जय सिनेमा भन्ने बानी नै भइसक्यो । जहाँ जाउन्, जोसँग भेटुन् नमस्कारको साटो जय सिनेमा भन्छन् उनी ।

दीपकले यस अभियानलाई अगाडि बढाउन अझ निरन्तर संघर्ष गरिरहेका छन् । जवानी हुँदासम्म मात्र कलाकारको महत्त्व हुन्छ, त्यसपछि ऊ अस्ताएको घामजस्तै निस्त्रिmय भएर बस्नुपर्ने अवस्था छ । यो प्रवृत्तिलाई चुनौती दिन 'जय सिनेमा' को अर्को अभियान हो । दीपकका अनुसार बुढ्यौली कलाकारलाई स्कुलमा कलासम्बन्धी पढाउने र सिकाउने मौका दिनुपर्छ । यसले कलाकारको सम्मान पनि हुन्छ र नेपाली कलाकारिताप्रति बालमनोभाव बढ्दै जान्छ । बान्तोवाको विचारमा यस अभियानले नेपाली चलचित्रको विज्ञापन गर्नेछ । २२ वर्षदेखि चलचित्र क्षेत्रमा छायांकनको काम गर्दै आएका बान्तोवाले तीन वर्ष पहिलेबाट यस अभियानमा लागेको बताउँछन् ।

दीपकले प्राविधिक भएर चलचित्रमा खेप्नुपरेको समस्यालाई पनि यसै अभियानबाट निरुत्साहित गर्ने योजनामा रहेको बताए । प्राविधिकले समयअवधिभन्दा बढी खट्नुपर्ने तर खटेअनुसार पारिश्रमिक नपाइने दीपकको गुनासो छ । बलिउडमा ८ घन्टाको एक सिफ्टको मान्यता दिइन्छ । तर कलिउडका प्राविधिकलाई तोकेभन्दा बढी काम गराउने प्रवृत्ति छ । यीलगायतका समस्या हटाउन दीपकले अब चाँडै नै नेपाल चलचित्र विकास बोर्डमा कुरा राख्ने भएका छन् ।

यसरी जय सिनेमा अभियानका तत्कालीन योजना निम्न छन् जिय सिनेमा क्लव गठन गर्ने चिलचित्र नभएको ठाउँमा चलचित्र पुर्‍याउन पहल गर्ने चिलचित्र प्राविधिकलाई निर्धारित समय, उचित पारिश्रमिकको व्यवस्था स्थापित गराउन पहल गर्ने ।

नेपाली चलचित्रको परम्परागत धारलाई परिवर्तन गर्ने उद्देश्यले निर्मित यो अभियानले के साँच्चिकै सफलता हासिल गर्नसक्ला त ?

Encounter

I am a 21 year old an average looking guy and my story begins when it snowed for the first time in Kathmandu; date - February 14th , 2007...a perfect day for a romantic couple to hangout together. After finishing my regular work day, I found myself enjoying myself in the protection of a hot coffee at a warm Café with a nice cos y ambiance. The room was quiet except for the mocking and grinding of the machines. She opened the door with one smooth motion and appeared inside with a glow in her cheeks and a big and beautiful smile on her face. I was comfortable on a corner couch slow typing my reply to my brother abroad, but when she came in I lost my breath. I couldn’t help but stare as she ordered her own cup of escape. She had wavy brown hair and a more than a shapely body. She stood at no more than 5 foot 5 and was built on a voluptuous 180-pounds frame. I was always attracted to big women but she had even more. I could feel myself being drawn towards her; she had a sparkle that I could feel as she looked at me.

Wait a minute; she was looking at me. I needed to do something, say something, even a wry smile would have been better than the dumb founded look I had on my face. However, I finally smiled at her and so did she; I closed my laptop, took a deep breath and made my way over to where she was now sitting. As I approached her I could smell her perfume, it smelled incredible, fresh and exciting. She was such a lady that everyone would fall for. She seemed almost unreal, like a mirage in this weird, city center coffee. I never imagined that I could see such a pretty woman in a place like this. I gathered all my courage to reach her table and fumbled out a hello accompanied with the most sincere smile I had in me.

Her eyes glistened as she smiled and her plump lips parted to speak. But I woke up…face down on my desktop in my cold office. Shapes of the keys indented in my cheeks and a series of pending works on my screen. What a dream, what a woman. If this was you for real, find me; make a man grateful to kiss you everyday.

Rumour city

The Nepal Army’s rank and file represents the country’s aspirations for democracy, rule of law and equal rights among various ethnicities

Kathmandu is a city of rumours, and rumours spread far and wide riding on the orbiting satellites. Before, the subjects spread rumours as a way of making sense of their rulers and the willful diktats of those inside the walls of palaces. Now, even after the palaces have turned into museums, rumours abound about the unpredictable ways of those who wield power — the power of the gun. Ever since President Ram Baran Yadav issued his order for Army Chief Rookmangud Katawal to continue, overriding the Maoist Prime Minister's dismissal of the general, serious journalists to conspiracy theorists have forewarned the people of a coup led by the celebrity Army Chief. This speculation has been based on rumours.
The rumour about a coup and counter coup by factions in the Nepal Army (NA) was first started by Kantipur daily even as the Army Chief issue was up in the air. Since Nepal's widely read daily said so and cited unnamed sources in the Army, the readers believed the rumour. Then, of course, the Army denied the rumour. And that was that. But then again, the speculative media and commentators began interpreting the Madhav Nepal government and its decisions regarding the Army as the victory of the Army, the ascendancy of the rightwing political forces, and rise of Katawal as a superman, a potential Ayub Khan or Ziaul Haque or somebody who will relegate the country to autocracy or dictatorship at worst and at best to a soft coup like that in Bangladesh.

Give us a break!

The first woman defense minister, the widow of a charismatic leader, may lack charisma and good sense about what she says to the press but Nepal now has too many leaders to let the generals get out of their barracks and run the country as its rulers. Katawal may have a classmate in the Indian Army Chief but it would be nothing short of suicidal if Katawal or the Indian Army Chief take it upon themselves to override the whole past few years and install a military backed government to write the constitution. Look at how many odds are stacked against any military adventurism:

a. Ram Baran Yadav

b. India's political establishment

c. The international community

d. Diaspora Nepalis

e. The Maoists

f. The seven party alliance and the people behind them

g. NGOs , INGOs, civil society and intellectuals

h. Nepal's regional geopolitics

Almost all the political forces are stacked against such a suicidal dare. Any attempt at a coup, soft or hard, at this time would destroy whatever political capital the NA earned when Prachanda and Badal in their political naiveté tried to mess with the NA unilaterally. It will destroy the capital they gained by supporting the transition to democracy and republicanism. This will not only jeopardize ex-king Gyanendra's chances of staying inside the country but will put Chief Katawal on the run to find a hiding place. And the NA itself will lose sympathy whether inside or outside Nepal. Given this scenario, why would any NA army officer think about supporting the foolishness of a handful of their rightwing, traditionalist colleagues?

Katawal or any small group of army generals is not the Nepal Army. The NA is a national institution and its rank and file represents the country and the country's aspirations for democracy, rule of law and equal rights among various ethnicities. Katawal and his resistance to change are a passing phase, and there may be others like him but they too will retire. The NA will remain as a dynamic institution, always evolving with the country, as it has done in its history, if not in lock-step, then following in its footstep.

Katawal's resistance to integration and recruitment of fresh soldiers against UNMIN's wishes followed by the Maoists unilateral attempt to fire him were both motivated by vested interests no matter how much the Maoists cry hoarse about civilian supremacy and Katawal come up with one ploy after another to establish the NA's sanctity, and thereby his own unwanted charismatic leadership, in the country's affairs. The Maoist and the Katawal episodes are in the past now. The Constituent Assembly (CA) is the supreme body. Nobody is superior to the CA no matter how mercurial and powerful he is. When the CA speaks in majority, it is, will be and should be the law of the land. Whatever any one individual says, whether it is Army Chief Katawal or a party boss, overriding everyone else is nothing but posturing. The CA's will is final in the country.

If the Madhav Nepal government goes, another government will come in its place but how can the constitution writing process stop? Nobody can stop this inexorable march of history in Nepal anymore. Despite its backwardness, illiteracy, poverty and all the ills and shortcomings, Nepal is in the grip the Nepali people and of the global forces, and both are for democracy. Look at the number of Nepalis, educated or uneducated, working outside of Nepal in so many countries. They send their remittances back but also keep an eye on what happens to their money and what happens to Nepal.

True, those whose traditional power base has been threatened, they may weep over a beer or whiskey how things are falling apart all around them in Nepal. It's their underserved, unfair privileges that are falling apart. Those who had never had a semblance of power and dignity, for them it's the new dawn, the beginning of a new era of dignity and recognition.

The Tarai armed hate groups are just that — hate groups. Many criminal elements have joined them to take advantage of the unstable situation. But there are among them groups and people who have a genuine commitment to the cause of the people of the Tarai because for them the institutions of the Nepali state are still filled with people with deep ethnic prejudices against the people of the Tarai or other deprived groups. I don't think there would be any Taraiwasi, no matter how assimilated into the mainstream, who doesn't remember encountering discrimination of some sort at some point in their lives, from the Village Development Committee (VDC) to the highest level of officialdom. And many of these individuals and groups in their shortsightedness have nursed the assault on their dignity and turned it into ethnic hatred. But that won't do. Bihari style caste hatred and animosity will not create a new society. Nor will silence create a new Nepal.

It's the job of the political parties and their leaders to convince these hate groups to channel their grievances politically. And it's the duty of the salaried security forces to weed out the criminals and force the armed groups to express their demands peacefully. Reward and punishment applies to everyone, including the political parties, their leaders and the security forces as much as the militant groups.

A short-sighted political leader from hill high castes may write a belligerent piece in the print media about civil war breaking out at any time as a result of undermining the privileges of Nepali speaking groups. A traditionalist NA general may vent his frustration over a drink about the disappearance of the old dispensation. An ambitious Madhesi political activist or group may threaten to take up arms and express hatred toward other ethnic groups or castes. The Kirat and Khambu groups may speak of and threaten to carve out a separate sovereign state. But these are all ways to vent one's frustrations in a new democracy and come to terms with the imminent changes in the political landscape. These must not be taken as signs of acting out on the words and gestures but as signs of growing pains of the republic.

Giving too much credence to rumours creates real wolves out of paper tigers. Army Chief Katawal who may not be heard again after he retires, like his predecessors, has been unnecessarily burdened with the weight of a superman. Let him retire and live in peace, like his mentor the ex-king, and receive well-wishers on birthdays. Let's not make too much of the Army Chief Katawal's pronouncements and let's get on with the main task of the CA: a twenty-first century constitution for a future Nepal.

Once Nepal has a constitution, things will fall into place. The institutions of state that are in a fix now will have solid ground to act and take the country and its people forward. Multicultural state institutions will always function better than those we have seen. And hope for the future always works better than the rumours of doom.

Window of opportunity

With the imminent retirement of CoAS Katawal, the Army leadership has an opportunity to redefine its role in line with the changed political circumstances
Chief of Army Staff (CoAS) Rookmangud Katawal has had a busy month. Less than two months before his retirement (a month before for voluntary retirement), he appears to be engaged on all fronts: lobbying with the government to allow the Army to recruit, to resume lethal and non-lethal military aid from India and promote favoured generals Toranjung Bahadur Singh and B.A. Sharma. Then there were his tours to barracks across the country, where he gave speeches warning that attempts are being made to destroy Army morale in the name of inclusion, and claiming that nowhere in the peace agreements does it say that Maoist combatants have to be integrated into the national army. And as is widely known, while in Kathmandu, Katawal has been cultivating a wide variety of people — diplomats, journalists, and even ad agencies — and attempting to build up a wide base of support.

So the Army has been more assertive and emboldened than it has previously been during the peace process. Always intolerant of criticism, it has now become more so, willing to react strongly to anyone who, the Army perceives as responsible for defamation of or unnecessary interference in the institution. For example, when the Representative of the UN Office of the High Commissioner for Human Rights (OHCHR) Richard Bennett met with Defense Minister Bidhya Bhandari to urge her not to promote Maj. Gen. Toranjung Singh to the position of lieutenant general as he was Brigade Commander of the Bhairabnath and Yuddha Bhairab battalions during the time when 49 people were tortured and disappeared under their custody in 2003. It was reported that Katawal met Bennett to tell him not to unnecessarily interfere in areas out of his mandate. Army Spokesman Ramindra Chhetri issued a statement that said that an internal Army report issued on Oct. 16, 2006, and presented to the Parliamentary Foreign Relations and Human Rights Committee and to OHCHR, had not found the said officer to be complicit in any human rights violations.

The exact nature of the culpability of Nepal Army officers is, in the absence of an independent investigation, difficult to ascertain. But what Chhetri did not mention in his statement was that the Oct. 16 Army report, already suspicious for having been produced by the very institution that was under scrutiny, was rejected by the parliamentary committee to which it was presented. Lawmaker and member of the committee Romi Gauchan was reported at the time as saying, "the report was not trustworthy and there are many contradictions over the facts within the report." Previously, the parliamentary committee had formed a one-member commission under Joint Secretary at the Home Ministry Baman Prasad Neupane to investigate disappearances. But, according to his testimony in July 2006, the Army did not cooperate with him and give him the required information. The committee then ordered the formation of a powerful and independent commission to probe disappearances but this never materialised. Instead, the committee was later informed by then Defence Secretary Bishnu Dutta Uprety that the report produced by the Army would be the final word on the matter.

The Army's attempts to obstruct independent investigations into its conduct during the war arise from its insecurity — which arose after the 2006 Jana Andolan — that all social and political forces are bent on undermining its institutional integrity. With the end of the war and the abolition of the monarchy, the Army faced a crisis of purpose as its traditional worldview collapsed. It felt threatened by ascendance of the Maoists and began to fear the aspects to the peace agreements that mentioned the integration of Maoist combatants and the democratization of the Nepal Army. Integration would lead to a massive influx of undesirables who would subvert the Army from the inside, it was felt, and democratization would leave the institution open to the whims of the political leaders who would subvert and undermine the institution from the outside. And the Army feared the Maoist socio-political agenda. It perceived the widespread demand for inclusive representation of all classes and ethnicities in state institutions including the Army to be a Maoist ploy to raise discontent within the Army ranks and undermine its chain of command.

As it is the Maoists who are largely responsible for all of the changes that have caused such insecurity in the Army, it is immensely difficult for the latter to look upon the Maoists as anything but the enemy, even though it has been over three years since the war ended. The strong rhetoric from the Army regarding Maoist designs to capture the state through military means — rhetoric that far exceeds any evidence regarding Maoist military capabilities or intentions — arises partially because of the Army's need to justify its existence. But there is also a real fear of “state capture”, which arises from the great vulnerability the Army feels regarding the social and political currents that the Maoists have introduced.

It is this vein of insecurity that Katawal tapped as chief of army staff. He felt that in order to prevent the political class from tampering with the Army, he had to take an assertive role. So soon after he became Army chief he began lobbying with politicians, making statements in the media about what politicians could and couldn't do and maintained a vehement stance against integration. In other words, in advocating for a strong Army with its traditional structure, culture and privileges intact, he assumed an openly political role that far surpassed what would be allowed of an Army chief in a democratic country with a military under firm civilian control.

Katawal's actions aroused discomfort among a large section of top Army generals. Trained as they were in doctrines of civilian supremacy, the Army chief's actions seemed improper. They resented and derided his attempts at cultivating his image and felt that many of his actions were geared towards fulfilling his personal ambitions. But they shared with Katawal the belief that the Maoists were bent on undermining their institution, and for this reason they supported his attempts to cultivate constituencies and assert the Army against any attempted political intervention — a process that climaxed with Katawal's political maneuverings to avoid being sacked by the Maoist prime minister.

Almost the entire top Army brass supported Katawal then; they were firm in their belief that the attempt to fire the Army chief was part of the Maoist attempt to take over their institution. But now that the incident is over, old resentments have resurfaced and even increased. In particular, there is uneasiness over Katawal's attempt to have his tenure extended. Although this may not have been directly expressed to Katawal's face, a number of top generals — including those who are often reported by the media to have accompanied the Army chief on his various lobbying visits to politicians — are strongly opposed to an extension of his tenure and have been using their own channels to make their opposition known.

At the moment it appears that despite Katawal's exertions, his tenure as Army chief will not be extended. Once he retires in September, the new Army chief and his advisors can follow one of two paths. First, they can continue to do what Katawal did and assert themselves openly, express their displeasure at the political class, adamantly refuse to undergo any reform and press the politicians in control to expand their budget and perks.

Or, preferably, they can realize that the political changes that have taken place over the past few years are irreversible. That to attempt to strengthen the Army according to its old structure and culture and isolate the Maoists would be to provoke conflict and invite another bout of bloodletting.
